Terms of Service
1. What this covers
These terms govern your use of the OCCLUDE software and the OCCLUDE Pro subscription service, operated by [BUSINESS_NAME], a ditta individuale registered in Italy (P.IVA: [PARTITA_IVA]). By using OCCLUDE or purchasing a license, you agree to these terms.
2. The software
OCCLUDE is a network fingerprint normalizer. It modifies your machine's outbound TCP/IP, TLS, and HTTP/2 parameters to reduce uniqueness.
- Free tier: TCP/IP normalisation. Licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). The full license text is in the LICENSE file in the source repository. The free tier is governed by the AGPL-3.0, not these terms.
- Pro tier: adds TLS and HTTP/2 normalisation via a proprietary plugin. Requires a valid license key. Governed by these terms.
3. License grant (Pro tier)
A valid Pro license grants you a personal, non-exclusive, non-transferable, revocable right to use the Pro plugin on a single machine at a time. You may not sublicense, redistribute, reverse-engineer, or decompile the Pro plugin.
4. License keys
Your license key is your sole credential. There are no accounts, no email addresses, no passwords. We store only a SHA-256 hash of your key and cannot recover it if you lose it.
You are solely responsible for backing up your license key. A lost key cannot be reissued. No refund will be issued for a lost key.
5. Hardware binding
Your license is bound to one machine at a time, identified by SHA-256 hashes of hardware components (machine-id, disk serial, CPU, NIC MAC). You may re-bind your license to a different machine up to 3 times per billing period. Re-binding is self-service — no support ticket required.
6. Payment
All payments are in Monero (XMR). Prices are displayed in EUR. All displayed prices include applicable VAT for EU customers. The XMR/EUR exchange rate is locked at the time you initiate purchase and held for the duration of the payment window.
- Monthly: €8.50/month. Valid for 30 days from activation.
- Annual: €69/year. Valid for 365 days from activation.
7. Subscription and expiry
Subscriptions do not auto-renew. When your license period ends, you have a 15-day grace period during which Pro features remain fully active. After the grace period, the Pro plugin deactivates and the software falls back to the free tier. OCCLUDE never bricks — the free tier always works.
To continue using Pro features, purchase a new license before or during the grace period.
8. Right of withdrawal
In accordance with EU Directive 2011/83/EU, Article 16(m): before completing your purchase, you will be asked to expressly consent to immediate delivery of the digital content (your license key) and to acknowledge that this consent waives your 14-day right of withdrawal.
The purchase flow includes explicit, unchecked checkboxes for both consents. If you do not check them, the purchase will not proceed. By checking them and completing the purchase, you receive your license key immediately and lose your withdrawal right.
9. No refunds
Because the license key is delivered immediately upon payment confirmation and the right of withdrawal is waived as described above, refunds are not available.
If you are unsure whether OCCLUDE will work for your setup, use the free tier first. The fingerprint test at occlude.sh/fingerprint lets you check your baseline before purchasing.
10. Conformity guarantee
Under the EU Digital Content Directive (2019/770), as implemented by Italian D.Lgs. 170/2021, you have a statutory guarantee that the Pro plugin will conform to its description and be fit for its ordinary purpose for the duration of your subscription, plus a minimum of two years from delivery. This guarantee cannot be waived and applies regardless of any other disclaimer in these terms.
If the Pro plugin does not conform, you are entitled to have conformity restored at no cost. If conformity cannot be restored within a reasonable time, you are entitled to a proportionate price reduction.
11. Revocation
We reserve the right to revoke a license if we detect:
- Activation on more than 20 distinct machines within any 30-day period (indicating redistribution).
- Payment fraud (e.g., use of stolen Monero, double-spend attacks).
Revocation is a last resort. We will not revoke a license for ordinary use, even if that use is aggressive about re-binding within the allowed 3 per billing period.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, the software is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not warrant that the software will be error-free or uninterrupted.
This disclaimer does not affect the mandatory conformity guarantee in Section 10, which applies in full.
13. Limitation of liability
Our total aggregate liability to you for any claims arising from or related to these terms or the software shall not exceed the total amount you paid to us in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these terms excludes or limits our liability for fraud, gross negligence (colpa grave), wilful misconduct (dolo), or any other liability that cannot be excluded under Italian or EU law.
14. Prohibited use
You may not use OCCLUDE to circumvent fraud-detection systems, conduct unlawful activity, or violate the rights of others.
15. Open source
The free tier of OCCLUDE is licensed under AGPL-3.0. These terms do not restrict your rights under the AGPL-3.0 in any way. If there is a conflict between the AGPL-3.0 and these terms with respect to the free tier, the AGPL-3.0 prevails.
16. Governing law and jurisdiction
These terms are governed by the laws of the Italian Republic. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of [CITY], Italy.
If you are a consumer habitually resident in the EU, you also retain any mandatory protections provided by the law of your country of residence.
17. EU Online Dispute Resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr.
18. Changes to these terms
We may update these terms. Changes take effect when published on this page. The "Last updated" date at the top will change. Continued use of the Pro tier after changes constitutes acceptance. We do not have email addresses to send notices to, so check this page periodically.
